Uber Accidents
Michigan Uber Accident Claims
Uber has transformed transportation across Michigan, but it has also introduced complex legal questions when accidents occur. Whether you are an Uber passenger, another driver hit by an Uber vehicle, a pedestrian struck by an Uber car, or an Uber driver yourself, the insurance and liability rules are different from a standard car accident. Koussan Law has the expertise to navigate these complexities and secure maximum compensation.
Uber's Three-Tier Insurance System
Uber's insurance coverage depends on the driver's status at the time of the crash. App off: Only the driver's personal auto insurance applies. App on, waiting for a ride request: Uber provides limited liability coverage. Ride accepted or passenger in vehicle: Uber's full commercial policy applies, providing up to $1 million in liability coverage plus uninsured/underinsured motorist coverage. Determining which tier applies is critical to identifying the correct insurance policy and maximizing recovery.
Michigan No-Fault Complexities
Michigan's no-fault system adds layers of complexity to Uber accident claims. PIP benefit priority depends on your status in the accident. As an Uber passenger, your PIP claim follows the priority rules under MCL § 500.3114 — starting with your own auto policy, then a resident relative's policy, then the vehicle's insurer. If you don't have auto insurance, Uber's commercial policy or the Michigan Assigned Claims Plan may apply. For third-party pain and suffering claims, the "serious impairment" threshold under MCL § 500.3135 must be met.
Common Uber Accident Scenarios
We handle all types of Uber-related accident claims: rear-end collisions caused by distracted Uber drivers checking the app, intersection accidents during pickups and drop-offs in unsafe locations, highway crashes caused by fatigued drivers working excessive hours, accidents involving Uber drivers unfamiliar with the area, and injuries from unsafe vehicle conditions in poorly maintained Uber vehicles.
