Toxic Exposure & Chemical Injuries
Michigan Toxic Exposure & Chemical Injury Claims
Toxic exposure cases arise when individuals are harmed by hazardous chemicals, pollutants, or contaminated substances — whether in the workplace, in their homes, or in their communities. Michigan has a long industrial history, and exposure to asbestos, lead paint, contaminated water, industrial solvents, and other toxic substances continues to cause serious illness and death. Koussan Law represents toxic exposure victims across the state.
Common Types of Toxic Exposure
Toxic exposure injuries take many forms: asbestos exposure leading to mesothelioma, lung cancer, and asbestosis — particularly in Michigan's automotive manufacturing and construction industries; lead poisoning from deteriorating paint in older Michigan homes and apartments; contaminated drinking water (as tragically demonstrated by the Flint water crisis); workplace exposure to benzene, formaldehyde, silica dust, and other industrial chemicals; pesticide exposure in agricultural communities; and PFAS ("forever chemicals") contamination increasingly found in Michigan's water systems.
Michigan Toxic Tort Law
Toxic exposure cases in Michigan may be pursued under several legal theories including negligence, strict liability, and product liability. The statute of limitations for toxic tort claims is generally three years from the date the injury was discovered or should have been discovered (MCL § 600.5805), which is particularly important because many toxic exposure injuries have long latency periods — mesothelioma, for example, may not manifest for 20 to 50 years after asbestos exposure. Michigan also allows claims for medical monitoring when exposure to a toxic substance creates a significantly increased risk of disease.
Building a Toxic Exposure Case
These cases require establishing a clear link between the toxic substance and your injury — which demands expert testimony from toxicologists, epidemiologists, and medical specialists. We also must identify all responsible parties, which may include manufacturers, property owners, employers, government entities, and waste disposal companies. The complexity of these cases demands a firm with the resources and expertise to take on well-funded corporate defendants.
