Birth Injuries & Medical Negligence
Michigan Birth Injury Claims
The birth of a child should be a moment of joy — not the beginning of a lifetime of medical challenges caused by preventable medical errors. When doctors, nurses, or hospital staff fail to provide the standard of care during pregnancy, labor, or delivery, the consequences for the child and family can be devastating. At Koussan Law, we pursue full accountability and maximum compensation for families affected by birth injuries throughout Michigan.
Common Types of Birth Injuries
Birth injuries resulting from medical negligence include cerebral palsy caused by oxygen deprivation during delivery, Erb's palsy and brachial plexus injuries from excessive force during extraction, brain damage from delayed emergency C-sections, skull fractures from improper use of forceps or vacuum extractors, and infections caused by failure to treat maternal conditions like Group B streptococcus. These injuries often require a lifetime of medical care, therapy, and specialized support.
Michigan Medical Malpractice Standards for Birth Injuries
Birth injury cases in Michigan fall under the state's medical malpractice framework (MCL § 600.2912a), which requires proof that the healthcare provider breached the applicable standard of care and that this breach was the proximate cause of the injury. Michigan law also requires filing an affidavit of merit from a qualified medical expert and providing a notice of intent to the defendant at least 182 days before filing suit. The statute of limitations is generally two years from the date of the malpractice, but for minors, the deadline extends until the child's eighth birthday in certain circumstances.
Fighting for Your Child's Future
Birth injury cases demand significant resources — expert medical testimony, life-care planning, and economic analysis to calculate future costs of care, lost earning capacity, and pain and suffering. Attorney Ali Koussan and the Koussan Law team have the experience and determination to take these cases as far as necessary, including to trial, to secure the compensation your child deserves.
