An insurer's action to enforce reimbursement or indemnity rights under section 3116 must be commenced within one year after the claimant received payment on the tort claim.

How this section works in practice

The mirror image of section 3145 for insurers. When an insurer has a right of reimbursement or indemnity under section 3116, for example after an out-of-state accident or a recovery against an uninsured driver, it must sue to enforce that right within one year after the claimant received payment on the tort claim. An insurer that learns of a settlement late does not get extra time; the year runs from the claimant's receipt of the money. Claimants and their lawyers should keep proof of the payment date, because it also fixes the date after which the insurer's lien can no longer be enforced by suit.

Sec. 3146.

An action by an insurer to enforce its rights of recovery or indemnity under section 3116 may not be commenced later than 1 year after payment has been received by a claimant upon a tort claim with respect to which the insurer has a right of reimbursement or recovery under section 3116.
